When you access or use the Mint*d website at www.mintdsmile.com.au (including any facilities such as your Mint*d Profile and booking functionality) ('Website'), you agree to be bound by these terms and conditions ('Terms').

Access to and use of this Website is provided by Dental Corporation Pty Ltd (ABN 92 124 730 874) trading as Mint*d Smile ('Mint*', 'We', 'Us' and 'Our') on the following Terms.

We reserve the right to change these Terms, the Website and any content available on or accessible from this Website ('Content') at any time by publishing these changes online. By continuing to use the Website, you are taken to have accepted any changes to the Terms.

1. Disclaimers, liability limitation and indemnity

1.1. Disclaimer

To the extent permitted by law, Mint*d, its affiliates and related bodies corporate (as defined by the Corporations Act 2001 (Cth)), will not be liable (whether in contract, tort (including negligence) or otherwise) for any loss or damage (whether direct, indirect, special or consequential) suffered by you in connection with your use of or access to this Website and its Content, or any failure to provide this Website or particular Content.

This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:

  1. Your reliance on the completeness, accuracy, suitability, currency, or availability of the Website or its Content.
  2. Failure or delay of performance or in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third- party conduct, or theft, destruction, alteration or unauthorised access to records.
  3. Failure to complete a transaction, booking or any loss arising from e-commerce or bookings transacted on the Website.

Mint*d’s total liability to you (if any) arising out of or in connection with your access or use of the Website shall be limited, at our election, to:

  1. In the case of information or services supplied or offered by us for a fee - the re-supply of the information or services or payment of the cost of doing this. We accept no, and exclude all, liability for information or services supplied or offered by us for free; and
  2. In the case of goods supplied or offered by us for a fee - repair or replacement of the goods, supply of equivalent goods, or payment of the cost of doing this. We accept no, and exclude all, liability for goods supplied or offered by us for free.

The Content on this Website (including oral health information) is not designed or intended to serve as a substitute for advice from a qualified healthcare professional. Content provided on this Website is general in nature and does not take into account the specific dental health issue, disease, dental complaint, dental problem or oral health concern you may have.

Where We mention specific products or services on this Website, We do so for informationaFl purposes only. This does not constitute a recommendation made by Mint*d, unless expressly stated.

You agree that you will not seek to rely upon the Content on this Website as health advice to remedy, address or self-treat any problems or concerns you may have either for yourself or for any other person.

You indemnify Mint*d and its affiliates and related bodies corporate against all liability, cost, expense, loss and damage incurred or suffered by Us as a direct or indirect result of you using this Website.

2. Mint*d Profile

2.1. Accessing your Profile

When you make a booking for a service at Mint*d (Mint*d Service), a profile (Mint*d Profile) will be automatically created for you based on the booking details you provide. Before you attend a Studio for your Mint*d Service, We will send you a code by email to access your Mint*d Profile through the Website. Each code provides single access and is active for 24 hours. If you require an additional code, simply request one via the Website and it will be automatically sent to your email address.

If you are 18 years or older, you must access and update your Mint*d Profile by providing further requested information before your visit. You warrant that any information you provide to Us is true and correct.

You are responsible for maintaining the confidentiality of the code provided to you which gives access to the personal information in your Mint*d Profile.

If the booking is for a person under 18 years, guardians/parents must access and update the Mint*d Profile on their behalf.

2.2. Identity

When you make a booking or access and update a Mint*d Profile, You warrant that you are the personreceiving the Mint*d Service (Guest), or the authorised guardian/parent of the ‘Guest’.

When you attend a Studio for your booking We will confirm your identity by confirming your mobile number or email address.

2.3. Profile Content

The following Content may be accessible in your Mint*d Profile (depending on what has been submitted by you and the Mint*d team - (Smile Crew)):

  1. your previous and future bookings for Mint*d Services;
  2. your patient information and medical history;
  3. your treatment plan (if applicable);
  4. other dental health records relevant to you.

Without any guarantees, Mint*d aims to keep your information accurate and up-to date.

2.4. Updating your Profile

If there is any health information or preferences you would like added to your Mint*d Profile, or if there is incorrect data recorded on your Mint*d Profile, please let your Smile Crew know or you can update some of your own information when you access your Mint*d Profile.

2.5. Profile Use

When you access your Mint*d Profile, you can:

  1. make bookings for Mint*d Services and edit bookings up to 24 hours beforehand;
  2. complete and update your personal information, preferences and medical history;
  3. view your treatment plans (if applicable);
  4. download PDF versions of your Mint*d x-rays or images (if applicable).

2.6. Maintenance and Availability of Mint*d Profile

You acknowledge that outages and downtime may occur in relation to your Mint*d Profile, including during any Mint*d Profile system maintenance (whether scheduled or otherwise). We make no representation about the availability of your Mint*d Profile. We may also impose limits on your use or access to the Mint*d Profile, including as required by law or if you breach these terms and conditions.

3. User conduct

3.1. Lawful and authorised use only

You must use this Website for lawful purposes only, including to access and view Content, make a booking, access and update your Mint*d Profile, and to submit enquiries or feedback to Mint*d.

3.2. Prohibited Use

You must not (a) use this Website in a manner which; or (b) upload, post, transmit or otherwise make available through this Website any material, which:

  1. violates or infringes the rights of others (including intellectual property or privacy rights);
  2. Is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, profane or which may harass or cause distress or inconvenience to, or incite hatred of, any person; or
  3. affects the functionality or operation of this Website or its servers or the functionality or operation of any user’s computer systems (for example, by transmitting a computer virus or other harmful component, whether or not knowingly).

4.1. Copyright Notice

Copyright in the Content (including text, graphics, videos, images, x-rays, audio clips, architecture, coding, design elements and interactive features) is owned or licenced by Mint*d. You may download or print hard copies of Content for your personal, private, non-commercial use. Otherwise, you may not reproduce, adapt, upload to a third party, publish or communicate any of this Content without Our prior written consent (except as necessary for viewing the Content on your browser, or as permitted under the Copyright Act 1968 (Cth)).

Nothing that you do on or in relation to the Website and its Content will transfer any rights in same.

4.2. Trade Mark Notice

“Mint*d” (the word and the logo) and any other trade marks associated with Mint*d, are trade marks owned by Mint*d or its related bodies corporate. You may not use Our trade marks without Our written consent. Third party trade marks which feature on the Website are owned by the respective third party. The use of a third party trade mark on Our Website does not indicate any association with, or endorsement by Mint*d, of that third party or its products/services.

5. Privacy, cookies and Google

5.1. Privacy

Mint*d takes your privacy seriously. Any personal information you provide through your use of the Website, (including your Mint*d Profile) or the Mint*d Services will be handled in accordance with the Mint*d Privacy Policy which is available at mintdsmile.com.au/privacy-policy.

5.2. Cookies

A 'cookie' is a small text file placed on your computer by a web server when you access a website. Cookies are frequently used on websites. Cookies in themselves do not identify the individual user, just the computer used.

Mint*d generally uses cookies to make a record of your visit to the Website and may log the following depersonalised information:

6. General Terms

6.1. Governing Law

These Terms are governed by the law in force in New South Wales, Australia. You agree that any disputes will be determined by the courts having jurisdiction in New South Wales in accordance with laws in force in New South Wales. You irrevocably and unconditionally submit to this jurisdiction.

6.2. Unenforceable Terms

If any provision of the Terms is found by a court to be invalid or unenforceable, the invalidity or unenforceability of the remaining Terms will not be affected.

6.3. No offers where illegality arises

Nothing on this Website constitutes an offer to provide goods or services in any jurisdiction if to do so would contravene the laws of that jurisdiction.

7. Payment Plans

Dental treatment should be accessible to everyone. At Mint*d, we want to help you get the dental care that’s right for you, but we understand that the cost of some treatments may not be within your budget. That’s why our Smile Crew are happy to provide you with information on dental payment plans, and other alternatives that can help manage the out-of-pocket costs of dental work.

Depending on your needs and circumstances, we can refer you to a third-party (a ‘buy now pay later’ provider) who offers payment options. Check out our Website for details on the third party providers we have partnered with. If you take up a payment plan you will be required to enter into a separate agreement with that provider and agree to be bound by their terms and conditions which are linked to the Website. Openpay

You could get the Mint*d Service you need today and pay over time with an Openpay Payment Plan at Mint*d. You can use a payment plan to pay for the full treatment or to cover a gap left after claiming. These payment plans include options such as a 20% deposit for amounts between $100 and $5,000, and repayment terms that extend from 2 months out to 24 months.

Zip

To make dental treatment more accessible, Zip is now offered at Mint*d. You can get the Mint*d Service you need today and pay it back in your own time, with up to 30 months’ interest free and no deposit. Zip offers a quick and simple sign-up process, flexible repayments (weekly, fortnightly or monthly) and a reusable account.

Afterpay

We know trips to the dentist can be expensive so smile now, pay later with Afterpay. You can use Afterpay to pay for Mint*d Services (spend limits apply). Pay the cost of your Mint*d visit across four easy payments made fortnightly, with no additional charges when you pay on time. Simply download the app from the App Store to sign-up to Afterpay, book an appointment and present your Afterpay barcode to one of our Smile Crew at our reception desk when it’s time to pay. 8. Bundles

Save across multiple treatments by selecting one of our tailor made bundle offers. There are a number of bundle offers to suit your needs. Bundles are valid for two years from the date of purchase.

9. Mint*d Membership

A Mint*d Membership includes:

  • 2 x dental examinations (RRP value $99)
  • 2 x dental hygiene scale and cleans (RRP value $187)
  • 2 x fluoride treatments (as required) (RRP value $56)
  • 2 x-rays (as required) (RRP value $74)
  • 2 x personalised treatment plans and intraoral photos (as required) (RRP value $82)
  • Free 12-month subscription to our partner oral health screening app so you can stay on top of things from home
  • 10% off all menu board Mint*d Services for the year

The Mint*d Membership annual cost $333 comprises:

  • 20% deposit of $62.60 (including OpenPay’s admin fee of $1.00 per payment) plus
  • 24 easy fortnightly payments of $11.27 (including OpenPay’s admin fee of $1 per payment)
  • Cost: $333 (GST is not applicable).
  • Payment must be processed using Openpay. By purchasing a Mint*d Membership you agree to OpenPay’s terms and conditions found at www.openpay.com.au/legal. For more information, please ask your Smile Crew Member, call Openpay on 1300 168 359 or visit www.openpay.com.au.
  • Due to the payment process, health insurance benefits are not claimable for treatments received under a Mint*d Membership.
  • A Mint*d Membership is valid for 12 months from date of purchase.
  • All treatments forming part of your Mint*d Membership must be booked (online or at the Studio) and received by you personally: before the expiry of the 12-month period; at the same Studio that you purchased the Mint*d Membership.
  • If the Mint*d Membership is for a child under the age of 18, their parent/guardian must provide consent to and be present at each appointment.
  • You may cancel your Mint*d Membership at any time, but you remain obligated to pay the full fee in accordance with OpenPay’s terms and conditions.
  • No refunds are available for change of mind or circumstances (to the extent permitted by law).
  • The treatments included in a Mint*d Membership may not be clinically suitable for everyone. Talk to a Smile Crew Member to determine if the Mint*d Membership is suitable for you and your oral health needs.
  • The treatments included in Mint*d Membership may be provided by a qualified oral health therapist or dentist depending on availability.
  • Your clinician may recommend further treatment/services outside of the treatments included in the Mint*d Membership at an additional cost, and you may require referral onto another clinician to provide the recommended treatment/services. Any such treatments which are not on the Mint*d Services menu board will not be eligible for the 10% discount included in the Mint*d Membership.

For the equivalent of less than a $1 a day access your Mint*d Membership straight away, no waiting periods or sign up fees.

10. Refer a Friend Promotion

If you have attended the Studio for a Mint*d Service you can refer a friend to Mint*d via a link We send to you by email, or in your Mint*d Profile. You and your friend will be rewarded with a promotional code giving you both $5 off your next Mint*d Service. Promotional codes are valid for 6 months from date of issue and cannot be used with any other promotional offer. Only one promotional code may be used per payment. Promotional codes cannot be used towards payment for subscription offers, bundle offers, the Straightener, or any further recommended treatment which does not form part of the standard list of Mint*d Services.
